Protecting your private information is our priority. This Privacy Policy governs data collection and usage of the products, services, software, platform and websites (collectively, "Services") provided by Amper Fitness Technologies, LLC and its affiliates (collectively, "Amper"). By using the Services, you consent to the data practices described in this policy and our Terms of Service. If you do not agree to any part of this Privacy Policy, then you should stop accessing the Services.

1. Collection of your Personal Information

Amper may collect personally identifiable information, such as your e-mail address, name and IP address. If you purchase our Services, we collect and store your billing and credit card information. When you register with Amper, we collect and maintain your account information such as login name, password, email address, contact information, age, height, weight and gender. Amper will not delete customer information other than upon customer request. However, Amper reserves the right to delete customer information for members with a free account status at any time.

Information about your computer hardware and software may be automatically collected by Amper. This information can include: your IP address, browser type, domain names, access times, operating system, cookie information, referring website addresses, and Internet Service Provider. Amper also collects geolocation information based on visitors' IP addresses. This information is used by Amper for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Services. In order to better understand how users use its site and to improve its services, Amper may also collect information about your use of our Site, such as Amper pages visited, links clicked, and text entered.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through the Services to third parties, such as YouTube or other video upload services, this information may be collected and used by them. Amper collects and uses your personal information to operate and improve our Services and deliver the Services you have requested. Amper does not sell, rent or lease its customer lists to third parties. Information about our customers, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personal information could be transferred to third parties as one of Amper's business assets. In such an event, you may ot have the right to opt out of any such transfer.

3. Use of Cookies

Our website uses "cookies" to help personalize your online experience. A cookie is a text file that is placed on your device by a web server. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to allow you to be logged in to your account. If you register an account with Amper, a cookie helps us recall your specific information on subsequent visits. This simplifies the process of recalling your personal information, such as billing addresses, shipping addresses, and so on. When you return to our website, the information you previously provided can be retrieved, so you can easily use the features of our Service.

4. How Users can Access, Change and Delete Their Information

You can access and change information previously submitted by logging into your Amper account, selecting "Account Settings" and editing the data fields there. You can also change payment information in your paid Amper account and remove payment information in terminated or downgraded accounts.5. For California Residents

Amper will need to collect information from the requesting party to verify their identity, and will respond within 45 days of receiving a personal information request (subject to an additional 45-day extension in certain circumstances)

5. Security and Retention of your Personal Information

You are responsible for safeguarding and preventing unauthorized access to the user information and password that you use to access our Services. You agree not to disclose your password to any third party and you are responsible for any activity using your account, whether or not you authorized that activity. Please immediately notify Amper of any unauthorized use of your account.

Amper uses industry standard security measures to secure your personal information from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Amper regularly reviews its security measures to consider appropriate new technology and methods. Please be aware that, despite our efforts, no security measures are perfect or impenetrable. Amper retains your personal information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.

6. Children Under Thirteen

Our Services are not intended for use by children under the age of 13, and such use is prohibited by our Terms of Service. We do not knowingly collect personally identifiable information from children under 13. The Website is hosted in the United States. Accordingly, by providing your personal information through the Website, you consent to the transfer of your personal information from your country of residence to the United States.
